Welcome to SMPLTSK. These Terms of Service ("Terms") govern your access to and use of the SMPLTSK mobile application and related services (collectively, the "Service"). By accessing or using SMPLTSK, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use SMPLTSK. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• Your use of the Service complies with all applicable laws and regulations

2. Service Tiers

2.1 Free Version

The Free Version allows you to:

• Create and send 1 image with up to 6 tasks
• Receive unlimited tasks from Premium subscribers
• Mark tasks complete
• Use in-app messaging
• Access all organizational folders (Sent, Received, Mine, Drafts)

2.2 Premium Subscription

Premium subscription ($60/year or $150/lifetime) provides:

• Unlimited tasks and images
• Send tasks to unlimited contacts (including non-subscribers)
• All Free Version features
• Priority support

2.3 Upgrading

You can upgrade from Free to Premium at any time through:

• Apple App Store (iOS)
• Google Play Store (Android)
• Stripe payment (web - subject to availability)

3. User Accounts

3.1 Account Creation

To use SMPLTSK, you must create an account using:

• Google Sign-In (Google account)
• Apple Sign-In (Apple ID)

Note: SMPLTSK does not offer email/password registration.

3.2 Account Security

You are responsible for:

• Maintaining the security of your Google or Apple account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Account Information

You agree to:

• Provide accurate account information
• Update information as needed to keep it current
• Not impersonate others or misrepresent your identity

4. Service Features

4.1 Photo-Based Task Management

• Upload photos to create visual task lists
• Place red markers on items needing attention
• Add descriptions to each marked task
• Change markers to green when tasks are complete

4.2 Task Sharing

• Send task batches to contacts
• Recipients can view photos, markers, and descriptions
• Both parties can update task completion status
• Use in-app messaging to communicate about tasks

4.3 Folder Organization

Tasks are automatically organized into:

• Sent: Tasks you've sent to others
• Received: Tasks others have sent to you
• Mine: Personal tasks for yourself
• Drafts: Unsent/incomplete task batches

4.4 Push Notifications

On first use, SMPLTSK will request permission to send push notifications. You can:

• Accept to receive task updates and reminders
• Decline and manage notifications manually
• Change notification settings anytime in device settings

5. User Content

5.1 Your Content

You retain ownership of all content you upload to SMPLTSK, including:

• Photos and images
• Task descriptions and markers
• Messages and comments

5.2 License to SMPLTSK

By uploading content, you grant SMPLTSK a limited license to:

• Store and display your content within the Service
• Share your content with recipients you designate
• Back up your content for service continuity

This license ends when you delete the content or your account, except as needed for legal compliance or service operations.

5.3 Content Restrictions

You may not upload, share, or transmit content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code
• Is defamatory, harassing, or abusive
• Contains explicit, obscene, or illegal material
• Violates others' privacy or publicity rights

5.4 Content Monitoring

While we don't actively monitor all user content, we reserve the right to:

• Review content for compliance with these Terms
• Remove content that violates these Terms
• Suspend or terminate accounts for violations

5.5 Shared Content

When you share tasks:

• Recipients can view and interact with the shared content
• You cannot delete or modify shared tasks after sending
• Shared content remains accessible to recipients even if you delete your account

5.6 Task Editing Limitations

• Once a task is sent, photos, markers, and descriptions cannot be edited
• Only completion status (red marker to green marker) can be changed by recipients
• Use in-app messaging for additional communication about tasks
• This policy ensures task integrity and accountability

5.7 Contact Import

• You may import contacts from your device's native contact list
• Only contacts you explicitly import are stored in our system
• We do not access your full contact list without permission
• You can delete imported contacts at any time

6. Acceptable Use

6.1 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service's operation
• Use automated systems (bots, scrapers) without permission
• Reverse engineer, decompile, or disassemble the app
• Spam other users or send unsolicited communications
• Abuse, harass, or threaten other users

6.2 Commercial Use

SMPLTSK is designed for both personal and commercial use. However:

• You may not resell or redistribute the Service
• You may not use the Service to compete with SMPLTSK
• Commercial use must comply with all applicable laws

7. Service Availability

7.1 No Guarantee of Uptime

We strive to provide reliable service but do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Availability at all times

7.2 Maintenance and Updates

We may:

• Perform scheduled maintenance with or without notice
• Update or modify the Service at any time
• Add, remove, or change features

7.3 Service Suspension

We reserve the right to suspend or terminate the Service:

• For violations of these Terms
• For maintenance or security reasons
• At our discretion with reasonable notice

8. Purchases and Payments

8.1 Subscription Plans

• Annual Subscription: $60 AUD per year
• Lifetime Subscription: $150 AUD one-time payment

Prices are in Australian Dollars and may be converted by payment processor.

8.2 Payment Processing

Subscriptions are processed through:

• Apple App Store (for iOS users)
• Google Play Store (for Android users)
• Stripe (for web purchases, subject to platform approval and availability)

We do not directly process or store payment information. All transactions are governed by the respective payment processor's terms and policies.

8.3 Billing

• Annual subscriptions renew automatically unless cancelled
• Lifetime subscriptions are one-time payments with no renewal
• You will be charged at the start of each billing period
• You can cancel anytime through your App Store/Play Store account settings

8.4 Refund Policy

All purchases are final and non-refundable, except:

• Where required by Australian Consumer Law
• Where required by App Store/Play Store policies
• In cases of technical errors resulting in duplicate charges

8.5 Cancellation

• You may cancel your subscription at any time
• After cancellation, you retain full access to your data and all features
• No partial refunds for unused subscription time
• Your subscription remains active until the end of the current billing period
• Lifetime subscriptions cannot be cancelled (one-time purchase)

8.6 Data After Cancellation

• All your data remains accessible after cancellation
• You maintain access to all tasks, photos, and folders
• You can still view and manage existing content
• Your account remains active for data access
• Data is only deleted when you explicitly choose to delete it

8.7 Free Version After Cancellation

After Premium subscription ends, you return to Free Version with:

• Continued access to all previously created tasks and data
• Ability to view unlimited received tasks
• Limitation: New tasks limited to 1 image with 6 tasks

8.8 Price Changes

• We may change subscription prices at any time
• Price changes apply to new subscriptions and renewals
• We will notify you of price changes before your next billing cycle

9. Intellectual Property

9.1 SMPLTSK Property

SMPLTSK and all related content, including:

• The app and its features
• Logos, trademarks, and branding
• Software, code, and algorithms
• Design, layout, and user interface

are owned by SMPLTSK and protected by intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use SMPLTSK for its intended purpose. This license does not include rights to:

• Modify, copy, or distribute the app
• Create derivative works
• Use SMPLTSK branding for commercial purposes

9.3 Feedback

If you provide feedback, suggestions, or ideas about SMPLTSK, you grant us the right to use them without compensation or attribution.

10. Privacy

Your use of SMPLTSK is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using SMPLTSK, you agree to our Privacy Policy.

11. Disclaimers

11.1 "As Is" Service

SMPLTSK is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or availability
• Error-free or uninterrupted operation

11.2 User Responsibility

You are solely responsible for:

• Your use of the Service
• Content you upload or share
• Backing up important data
• Ensuring task accuracy and completion

11.3 Third-Party Services

SMPLTSK integrates with third-party services (Google, Apple, Stripe, Firebase). We are not responsible for:

• Third-party service availability or performance
• Changes to third-party terms or policies
• Third-party data practices

12. Limitation of Liability

12.1 Liability Cap

To the maximum extent permitted by law, SMPLTSK's total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months before the claim arose.

12.2 Excluded Damages

We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Costs of substitute services

12.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy under Australian Consumer Law that cannot be lawfully excluded.

13. Indemnification

You agree to indemnify and hold harmless SMPLTSK, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you upload or share

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through app settings
• Contacting support@smpltsk.com

14.2 Termination by SMPLTSK

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period
• Required by law or legal process

14.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We will begin deleting your data per our Data Deletion Policy
• Shared tasks may remain accessible to recipients
• These Terms remain in effect for past activities

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

15.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts in Sydney, New South Wales, Australia for resolution of any disputes.

15.3 Informal Resolution

Before filing any legal claim, you agree to contact us at support@smpltsk.com to attempt informal resolution.

16. General Provisions

16.1 Changes to Terms

We may modify these Terms at any time. When we do:

• We will update the "Last Updated" date
• For material changes, we'll notify you via email or in-app notification
• Continued use after changes constitutes acceptance

16.2 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and SMPLTSK.

16.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.4 Waiver

Our failure to enforce any provision does not waive our right to enforce it in the future.

16.5 Assignment

You may not assign or transfer these Terms or your account without our consent. We may assign these Terms without restriction.

16.6 No Agency

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and SMPLTSK.
